Terms of service
for the Buddy app by NM Software Development UG (haftungsbeschränkt), Marc-Chagall-Str. 27, 04425 Taucha, Germany ("we").
This is a translation of the German Nutzungsbedingungen. The German version is the legally binding one.
1. Scope
These terms apply to the use of the Buddy app for iOS and Android and its associated services ("Buddy"). By creating an account you agree to them. The privacy policy is at findmybuddys.com/en/privacy/.
2. What Buddy is
Buddy helps you find people for shared activities. You propose an activity at a place and a time, or you join someone else's proposal. Buddy only makes the connection. We are not involved in the meetings, do not organise them, and do not vet the people who take part.
3. Adults only
You may use Buddy only if you are at least 18 years old. You enter your date of birth when setting up your profile and confirm that it is correct. We delete the account of anyone under 18 as soon as we become aware of it.
4. Account and sign-in
- You sign in with an existing Apple, Google or Microsoft account. That account is governed by the respective provider's terms. Buddy stores no password.
- You may hold only one account, for yourself, and may not hand it to others.
- Your display name comes from your sign-in provider or is chosen by you once when the account is created. It must not deceive or insult anyone or infringe the rights of others.
- Buddy is in a test phase (beta). We may suspend or delete an account that violates these terms (see section 8).
5. Your conduct
Buddy brings strangers together. That is why:
- Treat others with respect. Harassment, threats, discrimination, hate and sexual harassment are prohibited.
- Do not impersonate anyone and do not create fake profiles.
- Do not use Buddy for advertising, spam, commercial offers, fraud, or to collect other users' data.
- Do not propose illegal activities and do not upload illegal content.
- Do not interfere with the operation of Buddy, circumvent blocks, or try to access data not meant for you.
- Look after your safety at meetings: meet in public places, tell someone you trust, and leave a meeting if you feel uncomfortable.
6. Your content
- Content you put into Buddy (profile photo, event descriptions, messages) remains yours. You are responsible for having the necessary rights to it.
- You grant us a non-exclusive, royalty-free, worldwide right to store and process that content and to display it to the users it is intended for in the app. The right ends when you delete the content or your account, except for the cases described in the privacy policy in which messages remain in a group conversation without your name and reports are retained as evidence.
- We do not use your content for advertising and do not pass it on to third parties unless we are legally obliged to.
7. Reporting, blocking and moderation
- You can report people, events and messages in the app. Every report is reviewed by a person. You receive a notification once your report has been reviewed; we do not share the outcome concerning other accounts.
- You can block people. Blocked people and you no longer see each other in Buddy.
- As a host you can remove participants from your event; the removed person can no longer join that event.
- We may remove content and restrict, suspend or delete accounts that violate these terms or applicable law. Decisions are made by a person, not by an automated system. If we take action against you, we tell you the reasons to the extent the law requires, and you can contest the decision by email to management@nm-development.de.
- You can also report illegal content by email to management@nm-development.de (point of contact under the Digital Services Act).
8. Termination and deletion
- You can delete your account in the app at any time (Profile → “Privacy” tab → “Safety & data” → “Account & data” → “Delete account”) or deactivate it temporarily. The privacy policy describes what happens to your data on deletion.
- We may terminate your use with two weeks' notice by notification in the app or by email. For good cause, in particular a serious or repeated violation of section 5, we may suspend or delete an account immediately.
- We may discontinue Buddy altogether. We will announce that in the app at least four weeks in advance.
9. Availability and changes
Buddy is free of charge and in a test phase. We aim for reliable operation but promise no particular availability. We may change, add or remove features at any time and interrupt Buddy for maintenance. We are not obliged to develop Buddy further or to provide it for particular devices or operating system versions.
10. Liability
- Buddy is provided free of charge. We are therefore liable, except for damage resulting from injury to life, body or health, only for intent and gross negligence.
- To the extent liability would be excluded under the preceding paragraph, we are liable for the slightly negligent breach of obligations whose fulfilment is essential to the use of Buddy in the first place and on whose fulfilment you may regularly rely (cardinal obligations), limited to the typical damage foreseeable at the time the contract was concluded.
- We are not liable for the conduct of other users or for what happens at meetings arranged through Buddy. Claims under the German Product Liability Act and under any guarantee we have given remain unaffected.
- The limitations of liability also apply to our legal representatives and agents.
11. Changes to these terms
We may change these terms if the legal situation, Buddy's features or our processes change. We will inform you of a change at least four weeks before it takes effect, in the app or by email, and point out your right to object. If you do not object before the change takes effect, the changed version is deemed accepted. If you object, either side may end the use.
12. Governing law and dispute resolution
- The law of the Federal Republic of Germany applies. If you are a consumer habitually resident in another country, the mandatory protective provisions of that country remain unaffected.
- We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
- Should any provision of these terms be invalid, the remaining provisions remain in force.
13. Validity
These terms are valid from 15 September 2026. In case of discrepancies between the German and the English version, the German version prevails.
